JimNotes Terms of Service

1. Agreement to Terms

By downloading, installing, or using JimNotes ("the App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Rudeus LLC ("we," "our," or "us").

If you do not agree to these Terms, do not use the App.

2. Description of Service

2.1 JimNotes Overview

JimNotes is a fitness tracking mobile application that provides:

• AI-powered workout logging through natural language processing
• Progress tracking and analytics with Jim, your AI workout assistant
• Apple Watch companion app functionality
• Chat-based interface for workout management
• Personal fitness data visualization and export

2.2 AI Processing

Our service uses artificial intelligence (OpenAI GPT-3.5-turbo) to:

• Parse and interpret workout descriptions
• Answer questions about your fitness history through Jim
• Provide general fitness guidance and recommendations
• Classify user input to route to appropriate app functions

2.3 Apple Watch Integration

The App includes an Apple Watch companion app that:

• Syncs favorite workouts from your iPhone
• Allows quick workout logging directly from your wrist
• Communicates securely with your iPhone for data synchronization
• Provides fitness tracking functionality optimized for watchOS

3. User Accounts and Registration

3.1 Account Creation

• You must create an account to use JimNotes
• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 13 years old to create an account

3.2 Account Security

• You are solely responsible for all activities under your account
• Notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage from unauthorized account access
• You may delete your account at any time through the App settings

4. Acceptable Use

4.1 Permitted Use

You may use JimNotes for:

• Personal fitness tracking and workout logging
• Analyzing your own fitness progress and data
• General fitness education and guidance
• Apple Watch integration for enhanced workout tracking
• Interacting with Jim for workout-related questions

4.2 Prohibited Use

You may NOT use JimNotes to:

• Share or distribute another person's fitness data without permission
• Attempt to reverse engineer, hack, or compromise the App's security
• Use the service for any illegal or unauthorized purpose
• Impersonate another person or provide false information
• Attempt to overwhelm our servers or disrupt service functionality
• Use automated systems (bots) to interact with the App
• Share your account credentials with others

5. Credit System and Payments

5.1 Credit Usage

• JimNotes operates on a credit-based system for certain features
• Credits are consumed when using AI-powered features such as workout parsing and asking Jim questions
• New users receive complimentary onboarding credits
• You can view your current credit balance within the App

5.2 Credit Policies

• Credits are non-transferable and non-refundable
• Unused credits do not expire unless your account is deleted
• We reserve the right to grant promotional credits at our discretion
• Credit deduction occurs automatically when using applicable features

6. Privacy and Data Protection

6.1 Data Collection

Our data collection and use practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference. By using JimNotes, you also agree to our Privacy Policy.

6.2 Fitness Data

• All workout and fitness data you enter belongs to you
• We use your data only to provide and improve our services
• You can export or delete your data at any time
• We implement strong security measures to protect your information

7. Apple Watch and Device Integration

7.1 Device Requirements

• Compatible iOS device running iOS 17.0 or later
• Apple Watch running watchOS 10.0 or later (for Watch features)
• Stable internet connection for AI processing and data synchronization

8. Intellectual Property

8.1 Our Rights

• JimNotes, including all software, designs, and content, is owned by Rudeus LLC
• Our trademarks, logos, and brand elements are protected intellectual property
• The "Jim" character and related branding are owned by Rudeus LLC
• You may not use our intellectual property without explicit written permission

8.2 Your Content

• You retain ownership of your fitness data and content
• By using the App, you grant us a license to process your data to provide our services
• This license terminates when you delete your account or specific content

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability to you for any claims related to JimNotes shall not exceed the amount you paid for the App in the 12 months prior to the claim
• We are not liable for indirect, incidental, special, consequential, or punitive damages
• This includes loss of profits, data, or business opportunities

11. Termination

11.1 Termination by You

• You may terminate your account at any time through App settings
• Upon termination, your data will be deleted according to our Privacy Policy
• Some data may be retained for legal or security purposes as disclosed in our Privacy Policy

12. Apple App Store Terms

If you downloaded JimNotes from Apple's App Store:

• Apple is not a party to these Terms
• Apple is not responsible for the App or any claims related to it
• Any claims must be directed to Rudeus LLC, not Apple
